Terms of Service

1. Agreement to these Terms

These Terms of Service govern your use of ListingFilms.homes and any Vertical Listing Video, Complete Listing Video, Extended Property Film, preview, revision, or related production service purchased from ListingFilms (“ListingFilms,” “we,” “us,” or “our”). By placing an order, submitting media, or asking us to begin production, you agree to these Terms.

You must be at least 18 years old and legally able to enter into a binding agreement.

2. The service

ListingFilms is a done-for-you, pay-per-listing media-production service. We turn customer-supplied listing photos and optional video clips into edited property videos and manage each order through a customer dashboard. Current service scope, pricing, duration, aspect ratios, photo limits, turnaround targets, and included revisions are shown on the site or checkout at the time you order. If the site and these Terms conflict about a service-specific feature, the description shown at checkout for that order controls.

3. Order acceptance and payment

An order is not accepted until payment is successfully completed or we otherwise confirm the order in writing. We may decline, pause, or cancel an order before production if the media, instructions, property, requested use, or payment creates a rights, safety, compliance, or technical problem.

Prices are shown in U.S. dollars unless stated otherwise. You are responsible for any taxes, bank charges, or other amounts legally due in connection with your purchase.

4. Your source media and rights

You retain whatever rights you already have in photos, footage, logos, brokerage marks, floor plans, listing copy, and other material you submit (“Source Media”). You represent and warrant that you own the Source Media or have sufficient permission to let ListingFilms copy, modify, animate, transform, combine, and deliver it as part of the ordered project.

You also represent that your use of the Source Media and the finished deliverable will not violate a photographer’s copyright, brokerage agreement, MLS rule, seller agreement, trademark right, privacy right, or other third-party right.

5. License to process your media

You grant ListingFilms a limited, non-exclusive license to host, copy, resize, edit, animate, transform, transmit, and otherwise process the Source Media only as reasonably necessary to create, review, revise, store, and deliver your order, provide support, prevent abuse, and comply with law.

This license includes permission to send the Source Media and project instructions to service providers we use for hosting, dashboard functionality, file transfer, payment, AI-assisted media generation, rendering, upscaling, quality review, and delivery.

6. AI-assisted production and property accuracy

ListingFilms may use automated and generative tools to create camera motion, transitions, visual treatments, synthesized frames, cleanup, enhancement, upscaling, or other parts of the edit. Generated or transformed frames are not a recording made by a camera at the property.

We perform a final quality review intended to reject material changes that invent or misrepresent important property details. Generative systems can still produce imperfections. You are responsible for reviewing the final deliverable before publishing it and for deciding whether any disclosure is required by your brokerage, MLS, platform, client, or applicable law.

7. Customer review and publication responsibility

You are responsible for confirming that addresses, prices, dates, names, brokerage information, contact details, property features, disclosures, and other factual content are accurate before you publish or distribute the finished video.

“MLS version” or similar wording means we prepare an unbranded or cleaner export intended to make MLS use easier. It is not a guarantee that a particular MLS, portal, brokerage, social network, or advertising platform will accept the file. You remain responsible for platform and MLS compliance.

8. Creative control and revisions

Unless you provide specific instructions before production begins, ListingFilms may make reasonable creative decisions about shot order, pacing, motion treatment, typography, music, framing, crop, transitions, color treatment, and which submitted files are used.

A revision means a focused change to the existing project. A new source-media set, new concept, different property, major runtime change, replacement of most shots, or a substantially different creative direction may require a new order or additional fee. Included revision counts are those shown for the purchased service.

9. Turnaround and delays

Turnaround is measured only after we have received successful payment, usable Source Media, working file access, required branding or property information, and enough direction to begin. Stated turnaround times are targets, not guaranteed deadlines, unless ListingFilms confirms a guaranteed deadline in writing.

Missing files, broken share links, late changes, third-party outages, unusual re-generation needs, payment review, dashboard outages, or requested revisions can extend delivery. Order status shown in the dashboard is informational and may update in stages rather than reflecting every internal action immediately.

10. Refunds

Refunds and cancellations are governed by the Refund Policy. In general, an order may be cancelled for a full refund before production begins. Once production begins, the order is generally non-refundable because production resources have been committed, except where ListingFilms cannot provide the purchased deliverable or applicable law requires otherwise.

11. Final deliverables and usage rights

Final deliverables are made available through the order dashboard after the applicable payment and production requirements are satisfied. After full payment, and to the extent ListingFilms owns rights in the final deliverable, ListingFilms grants you a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, display, publish, crop, resize, and distribute the delivered video for marketing the applicable property and your real-estate business.

This does not transfer ownership of third-party music, fonts, stock assets, platform-licensed material, or Source Media owned by someone else. AI-generated elements may not qualify for exclusive copyright protection in every jurisdiction, and ListingFilms does not promise exclusivity in purely generated elements.

12. Portfolio use

ListingFilms will not publicly publish private Source Media or identify your project as a case study without permission. If you separately authorize portfolio use, that permission can be limited or withdrawn prospectively by contacting us, although material already distributed by third parties may remain accessible.

13. Third-party services and assets

We may rely on third-party payment processors, cloud storage, file-transfer tools, video-processing systems, AI-generation providers, music libraries, fonts, hosting providers, and other vendors. Their services may be subject to separate terms and availability. We are not responsible for outages or restrictions caused solely by a third-party service outside our reasonable control.

14. Prohibited uses

You may not use ListingFilms to create or distribute content that is unlawful, fraudulent, deceptive, defamatory, infringing, or intended to materially misrepresent a property. You may not submit media you know you do not have the right to use, impersonate another agent or brokerage, or ask us to fabricate material property features as if they were real.

15. No marketing-performance guarantee

ListingFilms provides creative production, not brokerage, appraisal, advertising-placement, or sales services. We do not guarantee views, leads, inquiries, offers, sale price, time on market, listing conversion, social reach, ad performance, MLS placement, or any other business result.

16. Disclaimer of warranties

To the fullest extent permitted by law, the site and services are provided on an “as available” basis. Except for the specific commitments stated in these Terms and our policies, ListingFilms disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights that cannot legally be waived.

17. Limitation of liability

To the fullest extent permitted by law, ListingFilms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost commissions, lost listings, lost data, reputational harm, or business interruption arising from an order or use of the site.

ListingFilms’ total aggregate liability arising from a specific order will not exceed the amount you paid ListingFilms for that order, except where applicable law does not allow that limitation.

18. Indemnification

You agree to defend, indemnify, and hold ListingFilms harmless from third-party claims, damages, losses, and reasonable costs arising from Source Media you submitted, instructions you provided, your publication or use of a deliverable, or your breach of the rights and permissions promises in these Terms.

19. Informal dispute resolution

Before filing a formal claim relating to an order, you agree to contact us at hi@listingfilms.homes with the order details and allow a reasonable opportunity to resolve the issue. Nothing in this section prevents either party from using small-claims court where eligible or exercising rights that cannot legally be limited.

20. Changes and severability

We may update these Terms as the service changes. The version in effect when you place an order will govern that order unless a change is required by law. If any provision is found unenforceable, the remaining provisions will continue in effect.
